We provide a version of phorum 3.4.8a which is XHTML compliant (XHTML 1.0 Transitionnal).

About XHTML compliance for Phorum 5 : Yes it may be compliant but as this version was not stable enough we used phorum 3
About the part 4 & 5 of the license : either I'm wrong, otherwise we did not made a "derived" product but just adapted templates to be XHTML compliant... Could you be clearer about what's going wrong for you ??

Before I get into this, let me say we welcome changes and help from our users. In fact, all the dev team, myself included are involved because we are also users of the code. But, I must explain our side of why this violates the license.
You took Phorum 3, altered it and are distributing the altered version under the name Phorum. Phorum 3 does not have templates like Phorum 5. Phorum 3 produces HTML from the internal code. For Phorum 5 you could create a new template and make it available for use with the official release of Phorum 5. This is not what you have done with phorum 3.
So, if you introduced some bug into Phorum with your changes to Phorum 3, someone may come here looking for help. Even worse, if you introduced some security issue, the security notices that go out to all the mailing lists will say "Phorum" on them. While your code may have done neither, the Phorum team can not allow just anyone to make a distro and call it Phorum.
So, you have three options:
1. name your distro something other than Phorum. Of course you have to keep the Phorum license and copyrights in the code.
2. Remove your distro and send us the changes for inclusion into the main source tree.
3. Release a patch to patch the official Phorum release.
Of course, you are free to use your modified Phorum 3 code as long as you want. There is no restriction against using it. The only restriction here is in the name. And like I said, that is an issue of maintaining the consistency of what the world knows as Phorum. The Phorum team must control any distro of the code called Phorum.
